Claudia H. P. Hoogewijs is a certified professional interpreter-translator with over 10 years' experience in legal translations, who is also a jurist, and masters the correct approach to the legal conversion between different judiciary systems and its technicality.


Claudia has been translating legal instruments, including court decisions and appels, official and regulatory documents, corporate contracts and legal agreements since 2008.



Sworn (certified)
Translations



Sworn translations (certified as true to the original) including the signature, declaration and official stamp1 of your sworn translator (expert oath sworn to the court of appeals of the judicial district of his/her domicile) for validity with judicial and consular bodies and authorities in Belgium and abroad.


1 As from December 1st 2022, according to the new legislation in force in the country, the official stamps used by sworn translators in Belgium have been replaced by an eID signature validated by the FPS Justice.



Legalized (Apostille)
Translations



Certified sworn translations that are, in addition, legalized by the addition of the Apostille issued by the Ministry of Foreign Affairs in order to be used outside Belgium.


In most cases, a certified sworn version is sufficient. In some cases, an Apostille or other legalization seal is necessary. If you have any doubts about the type of translation you need, check with the relevant competent body to make sure you have the type of document required.

The Risks of Inaccurate Legal Translations



The big issue with legal translations is the legal content, no secret.

Simply put, on legal translations, differently from any other translation content, it does not help to convey the source message into another language. Even not using your best legal dictionary. It is just not enough. You need to talk legal, and for that not only in-depth legal vocabulary is necessary but a broad knowledge of the differences between the foreign judicial systems from the respective countries and languages you are working with in order to achieve accurate results in legal translations.

You need accuracy without blindness because the judiciary pleadings have different denominations, the courthouses and judicial hierarchy are not similar to each other, the contractual terms and forms differ from one country to the other, the intended results plead by the parties differ from both lawsuits denominations and procedures depending on the respective legal system.

An inaccurate legal translation put in risk the main objectives of highly valuable documents through the eventual legal mistakes or mistranslations that may be further manipulated or misused as weak points and flaws by the third parties involved in the matter.

LEGALISATION OF SWORN TRANSLATIONS



Since December 1st, 2022, new legal measures have been implemented concerning the working method for all sworn translators and interpreters in Belgium. Among these, the traditional official stamps have been replaced by an eID signature validated by the FPS Justice for all sworn translators who hold permanent registration in the national register of sworn translators and interpreters in Belgium.


The judicial authorities can now, with the exceptions provided for by law, only call upon sworn translators whose registration has been validated in the national register. Other clients (citizens, administrative authorities, etc.) who also wish to use a sworn translator/interpreter must also contact a person registered in the national register.


Legalization (Apostille) is only necessary for any subsequent use of sworn translations as a legally valid document abroad.


(Case #1) : If the document is intended for use in Belgium : The legalization of the sworn translator's signature is required. The sworn translation is henceforth legal and valid in Belgian territory upon the apposition of the new eID signature validated by the FSP Justice.


(Case #2) : If the document is destined for use abroad : To obtain a legalization (Apostille) for use abroad, you must first obtain a valid certified sworn translation upon the apposition of the new eID signature validated by the FSP Justice for use in Belgium (see paragraph above). And then, an Apostille (legalization procedure issued by the Ministry of Foreign Affairs) hold by your sworn translator who is entitled by the FSP Justice Belgium to carry on with the legalization seal directly on the platform for sworn translators in possession of the valid and regulated eID signature validated by the FSP Justice.


Please always verify with the requesting competent authority whether an Apostille is required prior to taking any further action. CHECK HERE to verify if your sworn translation need a legalization with an Apostille.
